The symbolism is strong. Under the gaze of elements of the military police (PM) and Jaynet “Kabila”, a bulldozer from the Ministry of Urban Planning demolished, Monday September 4, the enclosure erected around the “GLM” building and the residence “Gecamines” restoring the movement of people and goods on avenues close to the home of ex-president “Joseph Kabila”. These arteries had been closed to the general public since the AFDL took power in 1997. Some Kabilie monks uttered wild cries denouncing a home invasion. According to a lawyer from the Kinshasa bar, “Kabila” occupies these places without title or rights.

“It’s a provocation”, trumpeted, Saturday September 2, the FCC Emmanuel Ramazani Shadary who did not hesitate to call as witness, in passing, “the national and international community”. And to add: “The DRC is in decline by at least 50 years”. The ex-raïs’ successors continue to believe that this enigmatic man – who set foot on Zairian-Congolese soil in 1997 – continues to bring rain and shine.

The main entrance to the “Gécamines” residence

This is particularly the case of Patrick Nkanga Bekonda who wrote on Twitter: “President Felix Tshisekedi is a future former head of state. Those who tell him that he will only do it with Jesus Christ are deceiving him. […]« . An allusion to the euphoric remarks made by Jean Marc Kabund the day after the inauguration of Felix Tshisekedi Tshilombo. “Patrick” to urge the current head of state to “be careful not to desecrate and humiliate his predecessor too much and therefore, the future status awaits him”. For the rapporteur of the PPRD political office, the treatment inflicted on their boss is unimaginable in countries such as Kenya, Ghana and Zambia.

CALL FOR “RESISTANCE”

Ramazani Shadary and Nkanga Bekonda pretend to be unaware that in addition to the breakup of the FCC-Cach coalition in December 2020 – notably following the humiliations suffered by “Fatshi” – former president “Kabila” committed a mistake by his “exit politics” of June 16th. In front of a handful of FCC executives gathered in Kingakati, the ex-raïs declared: “The passion I have for Congo has never wavered”. Instead of stopping there, he invited his supporters “to resist” et “to mobilize and mobilize the population”. To do what? It is, according to him, to counter “the dictatorship that is taking hold”.

This position was welcomed in “Fatshist” circles as a declaration of war. Some were firmly awaiting the media release promised by the ex-raïs, believing that the latter had violated the duty of reserve to which he is obliged in his capacity as former head of state. He therefore loses the privileges and immunities attached to this status.

Back to the GLM. Located a stone’s throw from the Ngaliema clinic, this building was initially the property of Belgian businessman William Damseaux. He had sold the commercial part, located on the ground floor, to Litho Moboti. The residential part which extends over 7 levels was acquired by individuals including companies. “Moreover, the registration register still indicates that the building belongs to the company Congo-Frigo de Damseaux, the transfers have not yet taken place”, points out family lawyer Litho Moboti, emphasizing that each party holds the sales agreement. This is a condominium.

SPOLIATION

On May 17, 1997, the Kadogos and Rwandan fighters hidden under the AFDL banner made their joyful entry into Kinshasa. The new masters of the country immediately gave an ultimatum to the occupants of the apartments. They must leave within an hour. It has been 25 years since the so-called “liberators” occupied – without title or rights – the disputed apartments. “It is property that belongs to the dignitaries of the Mobutu regime”supported the fallers of the “Great Leopard”.

According to the Litho family’s counsel, steps were taken in 2014 with Théodore Mugalu, then head of the civil household of the former head of state. “We asked him to invite the occupants not only to pay the rent but also to compensate the owners for the damage“, he said. According to this lawyer, Mugalu was offered the option to buy. No follow-up to date. In 2018, former special advisor Jean-Mbuyu Luyongola was approached. Without success.

“KABILA” DID NOT BUY THE GLM

The Litho family’s lawyer is categorical: “Joseph Kabila never bought this building. It is a spoliation”. According to him, this building being in co-ownership, it is impossible that “Kabila” could have acquired it for valuable consideration without disinteresting all the lawyers of the co-owners.

As we can see, ex-president “Kabila” is neither owner nor tenant of the GLM building. He has no title. The man took over the residence known as “Gecamines”, intended to accommodate the Prime Minister. He also took over the official residence of the President of the Legislative Council located opposite the Officers’ Mess.

The Minister of Urban Planning has demolished the barriers erected on the public highway in Gombe. To the great joy of local residents who can once again pass in front of the GLM building to reach the Congo River-Hotel or the Ngaliema clinic. On Twitter, several tweeters are calling for the application of article 12 of the Constitution advocating the equality of the Congolese before the law…
