TEGUCIGALPA, HONDURAS.-The criminal lawyer, versed in extradition proceedings, Raul Suazo assured that although there is the possibility of filing a new appeal to delay the ex-president’s departure from Honduras John Orlando Hernandezit will be difficult to reverse the ruling.
“Five magistrates who reached a unanimous decision are unlikely to change their decision in an appeal for reconsideration,” said Suazo.

The togado said that once they have obtained the missing signatures regarding the appeal heard by the full Supreme Court of Justice (SCJ), “the ex-president’s departure is imminent.”

The judicial device was filed by the legal representatives in order to revoke the decision issued in the first instance by the natural judge and ratified in the second instance by the plenary session of the Supreme Court of Justice (CSJ) in which the extradition of the former president was authorized.
Around 1:50 p.m. on Wednesday, the ad hoc Constitutional Chamber ruled to declare the appeal inadmissible to leave the path clear towards the extradition of the former Honduran ruler.
In one of the recitals of the resolution, the constitutional judges established that “that the issues raised by the appellants turn out to be allegations of mere legality, and it cannot be discerned from their proposals that constitutional guarantees have been violated in any way by making allegations of instances about arbitrariness and violations of constitutional rights.

Melvin Duarte, spokesman for the CSJ, asserted that with the resolution of the ad hoc constitutional chamber, “of course, the possibility that they can present an appeal for reconsideration is expedited; it is done before the same room within a period of 24 hours”. Some jurists assured that if Hernández’s defense files an appeal for reconsideration, it will also be dismissed.
The extradition of Hernandez Alvarado to the United States is stopped because the magistrates of the CSJ, who acted as a court of appeal, have not finished drafting and signing the sentence. The former president is claimed by the United States justice system for alleged links to drug trafficking.
