Dina Boluarte’s lawyer says that she had no legal responsibility for deaths in protests | PERU

The president’s lawyer, Dina Boluarte, reiterated this Saturday that the head of state has no legal responsibility for the deaths that occurred in the anti-government protests that shook the country between December and March for which the Prosecutor’s Office is investigating her.

”She has no legal responsibility in any way in this situation. The political responsibilities that may exist will have to be [determinarse] once it is established that in the situations we have seen and we regret the deaths (…) there was indeed a good or bad use of the weapon,” Joseph Campos told the RPP radio station.

In this sense, the president’s defense said that if it is shown that there was a good use of force, then there will be no legal or political responsibility.

“The context of violence is what we saw and some of the police officers that we have been able to see, because we have verified multiple statements and all have been consistent in saying that there was no instruction from Dina Boluarte,” he added.

Campos asked the Nation’s prosecutor, Patricia Benavides, on Wednesday to file the genocide complaint filed against the head of state for said deaths because she considers it proven that she did not participate in the accusation.

He also declared to RPP News that “continue to investigate and establish situations in which there was proper or improper use of force, and based on this, acquit or hold responsible; but that is not done in the way that is being investigated.”

In this sense, he confirmed that they have asked “the National Prosecutor to close this investigation, because there is a deterioration of the democratic authority that is devastating for the State.”

Campos added that “what we have seen is that violent demonstrations occurred that cannot be classified as protests,” and that the deaths that occurred in these mobilizations “are being investigated.”

“Here there was someone who maintained the anxiety and caused a context that must be investigated,” the lawyer said.

In a letter sent to the National Prosecutor, Campos points out that “it has been shown, during the preliminary investigation, that my client did not participate in the accused facts and that the objective and subjective elements of the accused crimes are not configured,” among they those of genocide, homicide and serious injuries.

“It has been ruled out that there was an order from the president for the purposes of the unfortunate deaths, which are still being investigated,” he said in the document.

She remarked that Boluarte only received a report at the end of the day of the actions to control the protests and that she had given instructions to adhere to respect for fundamental rights.

The president is being investigated together with several members of the Executive branch for the death of 49 people in direct confrontations with the forces of order, during the protests that took place between December and last February that called for her resignation and the closure of Congress.
