The man with breast cancer Ivan Andreev won the battle with the Health Fund in Plovdiv, which refused to grant him expensive treatment on the grounds that he is not a woman. The Supreme Administrative Court (SAC) ruled that the treasury’s decision was illegal.
DJ Ivan sued after being denied treatment last year. In its rationale, the Health Insurance Fund had indicated that the medicine was only given to women.
With its decision, the Administrative Court in Plovdiv indicated that the cash register had committed discrimination with its refusal. The treasury’s lawyers appealed to the Supreme Administrative Court, but ultimately lost.
In the reasons of the Supreme Court, it is written that the mentioned direct discrimination on the basis of gender is present, because Andreev was treated differently from women with his illness.
The principle of equality between women and men is proclaimed as such in the pharmacotherapeutic manual of medical oncology, where it is written that breast carcinoma in men is treated in an analogous way as breast carcinoma in women.
At the beginning of this year, the Health Insurance Fund still found a way to provide the drug for free to men with breast cancer, bTV reports. Every month, Ivan Andreev receives the necessary injections, but only in hospital care.
