The judge said Sheeran: “Did not intentionally or unintentionally” copy Chukri’s song. He admitted that there is a “similarity between the songs” in Shape of You and Oh Why, but said that “such a similarity is only a starting point for a possible copyright infringement”. After studying the musical elements, he said that there are “differences between the relevant parts” in the songs, which “provide convincing evidence that the expression”Oh I” In Sheeran’s song “comes from other sources.”
