Exactly 7 days after the first ever swearing in of an official cabinet in parliament – as elected governments regularly do, MPs will have to swear in official ministers for the second time.

Rokadi in the Ministry of Foreign Affairs and the Ministry of Agriculture asked the President Dimitar Glavchev and so on

three big question marks have agitated politicians and analysts.

First, what did Stefan Dimitrov and Kiril Vatev get in less than a week?

Second, what if the president refuses to issue new decrees for the two new ministers?

Mitov entered politics as a member of the DSB and for years was pointed to as a possible bridge between GERB and the right-wing coalition. He was acting foreign minister in the second cabinet of President Plevneliev.

Stefan Dimitrov angered Glavchev on Saturday night when he was undetectable during Iran’s missile attack on Israel. He also surprised several foreign ambassadors with his switched off phone – they wanted to know what Bulgaria’s position was. The team in Vuttno also had no contact with the boss, and so from Sunday they began to wonder if there would be any casting. Later, he explained to Dimitrov that he was in Podgorica to collect his luggage (he is the ambassador there), and in Montenegro the connection was bad.

However, there is something else – at the opening of the security conference in the Black Sea, which he is hosting on Monday together with the ambassador of Ukraine to our country, Dimitrov made a request that our aid to Ukraine would continue as humanitarian and emphasized that it should reach the Bessarabian Bulgarians. And he expressed hope that a peace forum in Switzerland in June could pave the way for talks with Russia. With a much harsher tone towards Moscow, the Minister of Defense Atanas Zapryanov spoke after him, who guaranteed “unwavering solidarity with Ukraine and its people in their struggle to oppose illegitimate Russian aggression”.

Glavchev’s official reasons for the requested change state “the need for timely and responsible coordination and communication between cabinet members, on the one hand, as well as with allies and partners, on the other.”

Failure to fulfill official duties, resulting in continued tension and discontent in the agrarian sector, without reaching the necessary legislative and management decisions with the necessary financial security, such as the Ukrainian aid to farmers for 2024 and the still unlaunched direct campaign payments, which creates serious difficulties in the sector.

These are the motives in Glavchev’s proposal to the president for the replacement of Kiril Vatev. He is one of the 4 ministers left from the “Denkov” cabinet. In his place, he proposes to appoint the executive director of the “Agriculture” fund, Georgi Takhov.

It is the compensations for the imported Ukrainian grain that are the reason for the requested replacement of Vatev, sources say. The disbursement of the aid totaling 180 million should start on Monday, April 22. Not only was there no organization, but also the money was not in the budget – the former Finance Minister Asen Vasilev “failed” to invest it, experts explain. Now the caretaker prime minister was counting on his new financial advisor Kiril Ananiev to find a way out.

Meanwhile, the “Agriculture” fund has been accepting applications literally until today

from the farmers for the aid to Ukraine and it will still be estimated how much money is needed. As its boss, Georgi Tahov can create the organization for the payments, sources say.

Takhov is a financier, he also specialized in economic and industrial management in Germany. He heads the fund since April 2022, before that he was in the NRA system, and in 2006 he became the head of the territorial directorate in Pazardzhik, and 3 years later – the deputy head of the consolidated Plovdiv directorate.

The farmers reacted immediately to the requested changes in their ministry – they came out with

angry position that they also want the immediate resignation

of Vatev. In an open letter to the president and acting prime minister, they accused him of: He brought our sector to liquidation and total ruin. No minister of agriculture has ever seen such chaos. Sometimes we had the feeling that we were on autopilot, but such “motorless flying” as in the last 1 year had not happened to us.

Their main concern is precisely the lack of pledged funds for Ukrainian aid.

At this stage, the Association of Grain Producers has not joined the open letter. According to its boss, Iliya Prodanov, regardless of who is the minister, they will not allow the money to remain unpaid.

For the first time, grain growers will receive money under the Ukrainian aid according to who cultivates how many acres. The association headed by Prodanov during the last protests was part of the negotiating team that signed the agreement with the government.

However, the question remains when the president will react to the requested changes. The fact that Glavchev is in Brussels until Thursday evening (see below) perhaps moves Radev’s answer to Friday.

There’s no way I can be a spokesperson for the president, it’s obvious that he

considers his own decision, collects any information – this is new situation with the changed ones texts in

the constitution commented Vice President Iliana Yotova. And he added that apparently not only are political crises deepening as a result of these changes, but new ones are also being born.

There is no specified term in the constitution and many lawyers assume that the “reasonable” is seven days, i.e. until monday.

After the changes, the president made it clear that he was not responsible for the cabinet – that’s why he sent him to be sworn in to the National Assembly, not to “Dondukov” 2. According to this logic, he should have agreed to sign decrees for the changes requested by Glavchev. This will confirm that the political responsibility for this power lies only with the acting prime minister and the parties.

If he refuses, the current ministers will simply remain,

they explain correctly. But we are entering a new constitutional crisis, others add.

The president is not obliged to sign the decree for the release of some ministers and the appointment of other ministers, commented the constitutionalist Orlin Kolev.

Otherwise, there is no obstacle to do it with a general decree. Or with two – Glavchev’s demands were separate.

In any case, if Radev signs the decrees for Daniel Mitov and Georgi Takhov, they must take an oath again before the National Assembly. This is an official government that imitates regularly, but with the president’s sanction, which is mandatory, explains constitutional law professor Hristo Ormandzhiev.

Yotova warned: Won’t it be the first election with unrecognized results?

This government does not pass the test, which means that the constitutional changes do not pass. The caretaker government itself is not charged with energy to fulfill its tasks – to guarantee fair elections, and it cannot make difficult and important decisions, it is not clear who bears the responsibility.

This was commented by Vice President Iliyana Yotova, answering questions about how the presidential institution accepted the request of the acting prime minister for the casting in Vutsno.

And he warned of the possibility of finding ourselves for the first time in our democratic history in a situation where the results of an election are not recognized.

“The situation is complicated for the whole country. This is not about the responsibility of one or another institution, but the responsibility towards all Bulgarians. Unfortunately, this official cabinet did not pass the test”, added the vice president.

She herself was surprised by the demand to replace the foreign minister.

Hristo Ormandzhiev: The reasonable term for the president’s decree is 7 days, if he refuses – a constitutional crisis

– Mr. Ormanjiev, can the president refuse to sign the decree for the replacement of the two official ministers?

– In principle, it is possible, but I think it will not happen, because a constitutional precedent will be created, a constitutional crisis.

If there is a desire of the Prime Minister to dismiss a minister, this need must be declared by presidential decree.

The decree must be signed in order to make the personnel change in the composition of the government. If he does not, he will not comply with the Prime Minister’s wishes.

In practice, Art. 99, para. 5 of the constitution in the new edition is actually associated with the responsibility of the prime minister and a registration regime of the president, who must approve the composition.

– Is there a deadline by which Radev must issue the decree?

– The Constitution does not say when it should happen. The problem is that there is no time limit, but it is generally accepted that it should be within a reasonable time. Seven days is accepted as a reasonable period.

– Can the National Assembly vote a vote of no confidence in the caretaker government?

– This is commented on in connection with the swearing in of the caretaker government before the National Assembly. But in practice it is a caretaker government, although the leading role is now that of the Prime Minister. It has the sanction of the president and that is its official nature.

His task is to prepare the elections. What is the logic of asking for a vote of no confidence and appointing a new caretaker government? It is therefore official, in order to prepare the elections and in relation to it there are no typical parliamentary moves.
