The draft law for the “Incorporation of Article 1 of Directive (EU) 2019/1151”, the amendment for the imposition of a Temporary Solidarity Contribution of 33% on the surplus profits of refining companies for the fiscal year 2023, is being submitted to the Parliament tonight, in accordance with the relevant provisions of Community legislation (Council Regulation 2022/1854).
The net income from the Temporary Solidarity Contribution is estimated at 300 million euros and as already announced will be used for the financial support in December of pensioners who will not receive an increase in their pension in 2025 due to a personal dispute, as well as for the increase of the Program of Public Investments.
The Temporary Solidarity Contribution is calculated based on excess profits as defined by Regulation (EU) 2022/1854, i.e. 33% on the taxable profits of the year 2023 that exceed 20% of the average results of the years 2018 to 2021, in proportion to the contribution also imposed on the taxable profits of the year 2022.
Until February 28
Refineries will have to submit a related electronic declaration to AADE by the end of September.
The Temporary Solidarity Contribution will be paid by February 28, 2025 and fiscally calculated in the year 2024.
It is noted that for refining companies the extraordinary levy will be reflected in tax year 2024 returns.
In addition, with a new provision, the possibility is provided to the Minister of National Economy and Finance to identify special activities, in which tax evasion is observed through the avoidance of card payment, and for them to define a special type of marking, with which professionals in Greek and English will inform their customers about their possibility to accept payments via POS and will also provide a telephone number for related complaints. Those who neglect this obligation will be fined 1,000 euros by the AADE or by the General Consumer Secretariat.
Finally, with the same amendment, compensation of 8.5 million euros is granted to the Sky Express company pending since the Covid-19 period, after its approval by the European Commission, in proportion to the aid received by European airlines.
