This is the second appointment made by the Cpccs during the administration of President Nicole Bonifaz, who took office in October 2023. In November of that year, they appointed, via competition, Mauricio Torres as Comptroller General of the State.

Fabrizio Peralta Díaz, former advisor to the legal secretariat of the Presidency of the Republicwas designated this March 28, 2024, by the Council for Citizen Participation and Social Control (Cpccs) as the first authority of the Superintendence of Data Protection.

The Data Protection Law was approved by the National Assembly two years ago. One of the functions of the new authority will be sanction alleged infractions due to the misuse of data, and those that could also be committed by public institutions that expose personal data without the restrictions required by law.

The misuse of personal data occurs, for example, when, without a person having authorized the delivery of their information, they receive calls offering credit cards, trips, promotions or changes in telephone company.

Article 66, paragraph 19 of the Constitution recognizes and guarantees the right to the protection of personal data, which includes access to and decision on information and data of this nature, as well as its corresponding protection. The collection, filing, processing, distribution or dissemination of this personal data will require the authorization of the owner or the mandate of law.

Fabrizio Peralta, specialist in Law and Technology, Data ProtectionLabor Law and Company Law, was chosen from a shortlist that was sent by the President of the Republic, Daniel Noboa on January 29, 2024 to the Cpccs.

The list of candidates also included Maria Paulina Casares, lawyer specialized in Computer Law; and the lawyer Luis Enriquez Alvarez.

This is the second designation carried out by the Cpccs during the administration of President Nicole Bonifaz who took office on October 7, 2023.

In November 2023, Mauricio Torres was appointed as Comptroller General of the State, and until the first days of April it was planned to appoint the head of the Public Defender’s Office. This contest is in the citizen challenge phase. (SC)
