SAO PAULO (Reuters) – Federal judge Flávio Lucas, of the 2nd Specialized Panel of the Federal Regional Court of the 2nd Region (TRF2), this Saturday partially overturned the injunction that determined the temporary suspension of the Telegram app in Brazil, the court said.

The decision was handed down after Telegram filed a criminal writ of mandamus against the measure imposed by the Federal Court of Linhares, in Espírito Santo.

In his decision, the judge defended that the suspension of Telegram “is not reasonable, considering the widespread affectation throughout the national territory of the freedom of communication of thousands of people who are absolutely strangers to the facts under investigation”.

Despite overturning the suspension, Lucas maintained the fine of 1 million reais per day to Telegram, for failing to comply with the determination to provide data of all users of the channel “Movimento Anti-Semita Brasileiro” and the chat “Frente Anti-Semita” .

According to TRF2, in his decision, the judge pointed out that the regulation of social networks in Brazil “is still insufficient and that it is necessary to establish clearer and more specific rules to avoid abuses”.

Last Wednesday, the Federal Court of Espírito Santo had determined the temporary suspension of activities on the Telegram platform in Brazil, while the company did not comply with a previous court decision to overturn the secrecy of extremist neo-Nazi groups that operate in the application.
