It is said that during the anti-discrimination student movement, as a result of massive repression and massacres by the previous Awami League government, the students, regardless of party affiliation, staged violent protests throughout the country and at one stage of the movement, the students united in a one-sided demand for the downfall of the government to demand the safety and justice of people’s lives. In the face of popular uprising, the then Prime Minister resigned to the President on August 5 and left the country. The President dissolved the 12th National Parliament on August 6.

According to the press release, the President sought the opinion of the Supreme Court in accordance with Article 106 of the Constitution of the People’s Republic of Bangladesh on the important question of forming an interim government to deal with the constitutional crisis, protect public interest and state security, keep the economic system functioning and run the executive functions of the state. Exercising the advisory jurisdiction provided in Article 106 of the Constitution, the Appellate Division of the Supreme Court of Bangladesh has on August 8, Special Reference No. 01/2024, opined that, ‘The Chief Adviser and other advisers as an interim measure to carry out the executive functions of the President in urgent need to fill the constitutional vacancy of the State. can appoint The President may administer oath to the Chief Adviser and other Advisers so appointed.’

It is said that, in view of the unanimous will and absolute intention of the people at all levels to deal with the constitutional crisis in accordance with the doctrine of necessity in the existing situation, based on the proposal of the representatives of the student-mass uprising and to fulfill the desire of the student-mass uprising for state reform and to carry out the executive functions of the state, the interim government was formed by the President on August 8. formed It is necessary to provide for the powers and duties of the Interim Government constituted, the rank and privileges of the Chief Adviser and Advisers, resignation and other incidental matters.
