Maternity pay is a benefit guaranteed by law to all women in the country with the purpose of guaranteeing their financial stability during the period when they need to be away from work due to the birth or adoption of one or more children.

This benefit also extends to women entrepreneurs who act as Individual Microentrepreneurs (MEIs).

MEI maternity salary

In order to ensure the financial security of entrepreneurs during the leave, the process differs slightly from the procedure adopted for women who are hired under the Consolidation of Labor Laws (CLT) regime.

In the case of pregnancy, it is necessary to apply up to 28 days before delivery, and the amount received corresponds to the minimum wage in force in the year – in 2023, the maternity salary is R$ 1,320.

Who has the right?

The accountant and finance specialist, who is also CEO of Fharos Contabilidade e Gestão Empresarial, Dora Ramos, explains that mothers who are MEI must follow some steps to request this benefit.

The first step is to access the Social Security website and register in the INSS system or use the “MEU INSS” application. Next, you need to fill out the application for maternity pay. At this initial moment, it is not necessary to go to a Social Security agency.

She points out that, to be entitled to maternity aid, the mother must be up to date with her monthly contributions as MEI, have correctly paid the Simples Nacional (DAS) Collection Document for a minimum period of 10 consecutive months, in addition to proving their status as MEI and the pregnancy or adoption of the child.

“After completing and documenting the application, the INSS will call the mother to apply for the benefit. The entrepreneur must present an original identification document with a photo, CPF number, booklet and proof of payment to the INSS, as well as the birth certificate of the child. In the case of adoption, the document issued after the court decision must be presented”, explains the accountant.

It is important to note that maternity leave for individual micro-entrepreneurs lasts for 120 days, which is equivalent to 4 monthly installments, and is applicable in cases of baby birth, adoption, legal custody or stillbirth.
