MEIs (Individual Microentrepreneurs) are entitled to Social Security benefits through the payment of taxes to the INSS (National Social Security Institute).

The category pays social security taxes using a simplified guide. The amount (R$66 in 2023) is equivalent to 5% of the minimum wage. In other professional categories linked to the CLT (Consolidation of Labor Laws), the percentage varies from 7.5% to 14% – depending on income.

The MEI has the right to retire due to age. The rule follows the standards of the labor reform approved during the government of Michel Temer (MDB):

for those who started paying INSS from November 13, 2019 – the man must be at least 65 years old, with a minimum of 20 years of paying the tax. For women, the age is 62 years with 15 years of payment;
before the date – the man must be at least 65 years old. For women, the age is 60 years. Both must have paid tax for at least 15 years.

As the individual microentrepreneur is a relatively new category, created in 2008, people who had their first job through this modality began to retire from 2023.

Individual microentrepreneurs cannot retire based on working time, as is the case under the CLT regime, for example. Social security lawyer Fernando Vitorino says that this point tends to confuse MEIs, who think they have the right to retirement for working time as well. “Many people make mistakes when planning,” he said.

The expert says that the MEI INSS can be “cumulated” with that of previous categories. For example, if a person was a CLT worker and later opened the MEI, the minimum contribution time for retirement due to age also takes into account previous experience.

According to the federal government, the category is also entitled to other benefits, such as disability retirement (when the entrepreneur loses the ability to work due to a permanent disability, for example). Furthermore, you have the possibility of having access to:

sickness benefit; maternity pay; confinement aid; death pension.

According to the most recent data from Mdic (Ministry of Development, Industry, Commerce and Services), Brazil had 11.6 million MEIs in November 2023.

There are more than 460 activities that can be carried out by MEIs. The federal government provides a list of professions that authorize registration.

The other criteria cover the following themes:

age and nationality – you must have Brazilian nationality and be over 18 years old.
invoicing – can earn up to R$81,000 annually (R$6,750 per month). If the value exceeds the stipulated amount by more than 20% (R$97,200), the worker must change his business model from the following year onwards. There is no minimum value imposed to register.
business – MEI cannot be associated with another company as a partner or owner. It is also prohibited to have partners in your own company.
employees – the entrepreneur can only have one contractor in his business. Hiring must be under the CLT regimes.

Foreigners can become MEIs, as long as they have a National Migration Registration Card, a Provisional National Migration Registration Document or an Asylum Request Protocol.

For people of other nationalities with a temporary visa in Brazil, registration is only granted to those born in Mercosur countries.
