The renowned American social media company Meta was fined this Monday, May 22 for 1,200 million euros (about 1.3 billion dollars) after being accused of breach data protection regulations with Facebook.

The company founded by Mark Zuckerberg plans to appeal the decision, for which it was convicted of have “transferred personal data” of users from the platform from the European Economic Area to the United States, as explained by the Irish Data Protection Commission (DPC).

The DPC acts on behalf of the European Union with the possibility of monitoring the application and compliance with the General Data Protection Regulation (RGPD) of the EU, since Meta’s European headquarters are located in Ireland.

As a result of the sanction imposed in Europe, the company must “suspend all transfers of personal data to the United States within five months” from the notification of the decision, in order to comply with the GDPR within six months.

This was the highest fine imposed by a data protection regulator in Europe and derived from an investigation initiated in 2020. In addition, it is worth mentioning that it is the third penalty that receives the signature in the EU since the beginning of 2023 and the fourth in a period of six months.

However, Meta described the sanction as “unjustified and unnecessary”, for which he announced through a statement that they will appeal to the courts to try to suspend it. In turn, the company expects the United States and the European Union to adopt a new legal framework for the transfer of data in the coming months.

“Thousands of companies and organizations depend on the ability to transfer data between the EU and the United States,” they argued from the company and explained that “there is a fundamental legal conflict between US government rules on data access and European privacy rights”.

The social media giant had received a fine of almost 400 million euros in January for violations in the use of personal data for advertising purposes in their applications. While shortly after, in March, she was again fined for €5.5 million for violating the GDPR on the WhatsApp messaging platform.
