JAKARTA – Presidential Special Staff Coordinator Ari Dwipayana emphasized Firli Bahuri will be dismissed from his position as Chairman of the Corruption Eradication Committee after becoming a defendant. Currently, Firli is filing a pre-trial lawsuit regarding the designation of himself as a suspect in the alleged extortion case against former Minister of Agriculture Syahrul Yasin Limpo (SYL).
“The law has also regulated it. When you become a defendant, for example, there will be a change in status regarding temporary dismissal later,” said Ari in his statement, Friday (24/11/2023).
Article 32 of Law number 19 of 2019 explains several things that mean the KPK leadership can be dismissed. One of them was after becoming a defendant for committing a crime.
Article 32
(1) The leadership of the Corruption Eradication Commission resigns or is dismissed because:
– die
– end of term of office
– committed a reprehensible act
– become a defendant for committing a crime
– permanently or continuously unable to carry out their duties for more than 3 months
– resign; or
– subject to sanctions based on law
Ari explained that the Ministry of State Secretariat (Kemensetneg) had received a notification letter regarding the determination of the suspect in the name of the Chairman of the Corruption Eradication Commission, Mr. Firli Bahuri, on Thursday (23/11/2023) afternoon at 17.00 WIB. After receiving the letter, said Ari, the Ministry of State Secretariat will prepare a draft Presidential Decree (Keppres) on the temporary dismissal of the KPK chairman and also the appointment of an interim chairman.
“So there are two contents of the presidential decree. One, related to the temporary dismissal of the chairman of the Corruption Eradication Commission and the second is the appointment of the interim chairman in accordance with Law 19 of 2019 concerning the second amendment and also refers to Perppu Number 1 of 2015 which was passed by the DPR as Law Number 10 of 2015,” he explained.
Ari revealed that the Presidential Decree will be signed by President Jokowi after the person concerned returns from his working visit this evening. “Yes, after he landed in Jakarta,” said Ari.
For your information, Polda Metro Jaya named KPK Chairman Firli Bahuri as a suspect in the alleged extortion case against former Minister of Agriculture (Mentan) Syahrul Yasin Limpo.
“Held the case with the results of finding sufficient evidence to designate FB’s brother as chairman of the Indonesian Corruption Eradication Committee as a suspect in a case of alleged extortion or recipient of gratuities or gifts,” said Director of Criminal and Criminal Investigation of Polda Metro Jaya, Police Commissioner Ade Safri Simanjuntak, Wednesday (22/11/2023).
