For the third time, President Noboa insists on the state of emergency in seven provinces – La Nación

After two refusals from the Constitutional Court, President Daniel Noboa issued a third decree to order a state of emergency in Guayas, Los Ríos, Manabí, Orellana, Santa Elena, El Oro and the Camilo Ponce Enríquez canton, in Azuay.

President Daniel Noboa is looking for a way to sustain a focused state of exception, under the argument of insecurity. For this reason, it issued a third decree with the measure, this July 2, 2024, with a duration of 60 days.

The executive decree aims to keep the military on the streets of the most violent provinces and cantons in the country: Guayas, Los Ríos, Manabí, Orellana, Santa Elena, El Oro and the Camilo Ponce Enríquez canton, in Azuay.

However, the Constitutional Court (CC), as during the pandemic, canceled the states of exception because they did not have valid arguments. The magistrates established that the arguments mentioned in the decrees did not specifically constitute the cause of internal armed conflict, nor did they justify it in any way.

Therefore, on this occasion, the 49-page document dedicates the first 45 to the explanatory memorandum. Among them, “the increase in hostilities, commission of crimes and intensity of the prolonged presence of organized armed groups” in the aforementioned jurisdictions.

And it orders the suspension of the rights of inviolability of home and correspondence, to carry out inspections, raids and the corresponding searches by the Armed Forces and the National Police. The right to free association and assembly is also suspended “in strict relation to the reasons for the state of emergency.”

On this occasion, after the two previous failures, the Government began a type of advertising campaign in favor of the state of emergency. And to this end, the Presidency announced that the new decree has the endorsement of the World Association of Jurists (WJA).

In a video broadcast on its social networks, the Executive showed the members of this Association speaking out in favor of the state of emergency. José Estévez, one of them, stated that the reasons that led to the first declaration persist in the country. Although this decree comes into effect immediately, its permanence will depend on the mandatory analysis of the Constitutional Court, which must rule in the coming days.
