Forced to pay 2.5 billion, Tra Ngoc Hang appeals

Forced by the People’s Court of Thu Duc City (HCMC) to pay Mr. Nguyen Quang Tan 2.5 billion VND, model Tra Ngoc Hang has just appealed the entire first instance verdict.

According to the case, in 2020, the model Ngoc Hang Tea I met Mr. Tan through the introduction of his girlfriend, Miss Yen Oanh.

Knowing that Ms. Hang needed money, Mr. Tan transferred the right to use some land plots in Da Teh district, Lam Dong, to Ms. Hang as collateral to borrow 13.2 billion VND from the bank.

After the disbursement, Ms. Hang kept 2.5 billion VND, Mr. Tan kept 10.7 billion VND with the agreement that each person would pay the interest arising from the principal loan amount.

After a while, Ms. Hang stopped paying interest, not following the original agreement. Claiming that Ms. Hang was evading her obligation to pay interest, affecting the loan and collateral, Mr. Tan filed a lawsuit to reclaim 2.5 billion VND.

At the first instance trial, Ms. Hang stated that in 2020, Mr. Tan needed a large sum of money for business but had bad debt at the bank, so he asked her to help him borrow. Because she herself needed a loan, she borrowed it for Mr. Tan.

According to Ms. Hang, when the bank disbursed the loan, Mr. Tan received 9 billion VND, and she borrowed 2 billion VND. The two parties agreed that each person would pay the interest corresponding to the loan and Mr. Tan had to pay in full and on time to avoid her account being in bad debt. If Mr. Tan had bad debt, she would not be responsible for paying the principal.

About a month later, Mr. Tan asked her to borrow another 2 billion VND with the agreement that Mr. Tan would receive 1.5 billion and Ms. Hang would receive an additional 500 million VND. However, while waiting for the disbursement, Mr. Tan did not pay the interest on the previous loan, so she had to pay the interest on Mr. Tan’s entire loan.

Ms. Hang said that Mr. Tan’s delay in paying interest caused her to fall into the bad debt group and the bank repossessed the car she was paying in installments. Based on the agreement via text message, Ms. Hang said that she had no obligation to pay Mr. Tan 2.5 billion VND.

During the process of resolving the case, Ms. Hang handed over the certificate 655, analyzing the reasons, including the content that Mr. Tan promised to handle bad debt and buy a car for her. This is considered evidence to prove the agreement that if Mr. Tan does not pay interest causing her to have bad debt, she will not pay both principal and interest of this amount.

The court of first instance determined that Mr. Tan was the one who actually paid the loan of 13.2 billion VND to the bank, and Ms. Hang received 2.5 billion VND from the loan, so Mr. Tan had the right to claim it back. In addition, after reviewing the entire content of the 655 minutes, the panel of judges did not see the agreement as Ms. Hang presented.

From there, Thu Duc City People’s Court forced Ms. Hang must pay back 2.5 billion VND for Mr. Tan.
