The Court of Appeals of Santiago revoked preventive detention to the former director of the Investigative Police (PDI) Sergio Muñoz, and changed his precautionary measure to nighttime house arrest and national roots.

In this way, the appeal court accepted the appeal presented by the defense of the former police chief, after last March the Fourth Guarantee Court of Santiago decided that Muñoz should wait in prison for the 120 days established for the investigation, after being accused of violation of secrecywithin the framework of the Audios Case.

As the court argued when announcing its decision, it was based on the fact that The former police chief has collaborated with the investigations that are carried out, after being accused of leaking information to lawyer Luis Hermosilla, regarding the investigations that were carried out regarding the case of his predecessor as head of the PDI, Héctor Espinosa.

In this regard, Muñoz’s defense lawyer, Juan Carlos Manríquez, said that the decision was also based on the fact that “to date there is no precedent that allows us to presume that Mr. Muñoz Yáñez will be removed from the action of justice“.

Along the same lines, Manríquez emphasized that his client “has appeared at all acts of the procedure, has raised its current accounts and has given a statement” every time it has been requested.

For all of the above, the prosecution charged Sergio Muñoz with the crime of violation of article 31 of Law 19,913 and violation of article 246 of the Penal Code.
