The Supreme Court’s ruling on former independent lawmaker Yoon Kwan-seok (then of the Democratic Party of Korea), who was sent to trial for ‘suspicion of receiving money from the Democratic Party’, will be announced on the 31st. This is the first Supreme Court ruling on a money envelope incident involving former and current lawmakers.
According to the legal community on the 14th, the 2nd Division of the Supreme Court (Chief Justice Oh Gyeong-mi) will hold an appeal hearing on the 31st for former Rep. Yoon, who was indicted on charges of violating the Political Parties Act.
Former Rep. Yoon was put on trial on charges of being involved in distributing money envelopes to help former Representative Song Young-gil (currently the representative of the Pine Tree Party) get elected ahead of the Democratic Party’s National Convention in May 2021.
The prosecution said that Kang Rae-gu, former standing auditor of the Korea Water Resources Corporation, and others delivered 60 million won, which is a combination of 50 million won in donations received from businessman Mr. Kim and camp funds, to former lawmaker Yoon over two days on April 27 and 28 of the same year. It is believed that he delivered 3 million won each to 20 other lawmakers.
The first trial sentenced former Rep. Yoon to two years in prison last January. Former Auditor Kang, who was brought to trial on the same charges, was sentenced to 1 year and 8 months in prison and a fine of 6 million won, and was also ordered to pay a fine of 3 million won.
The first trial court said, “The defendants raised an illegal amount worth 60 million won and deliberately provided money and valuables for the purpose of giving it to members of the National Assembly, so the illegality is also serious,” and “The public’s trust in political party democracy has been greatly damaged again.” “The guilt of the defendants who led the crime is very serious,” he pointed out.
The second trial sentenced former Rep. Yoon to two years in prison, as in the first trial. Former Auditor Kang was also sentenced to 1 year and 8 months in prison and a fine of 6 million won, as in the first trial.
The second trial court said, “The people, who are sovereign, implement democracy through political parties, so committing fraud, such as bribing voters with money in elections within a political party, is a serious crime that shakes the foundations of democracy,” and added, “It is a serious crime to shake the foundations of democracy.” “The actions of the defendants who instructed them to provide and received money or valuables are highly illegal and highly reprehensible, so severe punishment is inevitable,” he said.
The Supreme Court is expected to also issue a decision regarding the bail requested by former Rep. Yoon last September. Meanwhile, former Auditor Kang, who was also sent to trial, submitted a withdrawal of appeal on the 2nd and will not be subject to a separate Supreme Court judgment.
Former lawmaker Yoon was also indicted on charges of delivering or receiving an envelope containing 3 million won at a support meeting for then-party representative candidate Song Young-gil ahead of the 2021 Democratic National Convention, and was sentenced to 9 months in prison and 2 years of probation in the first trial. . In addition, he was additionally indicted on charges of receiving bribes worth 20 million won in return for lobbying legislation.
