Last week, the US Federal Trade Commission (FTC) opened a preliminary investigation examining whether the replica investments of the technology giants Microsoft, Google and Amazon in the generative artificial intelligence startups OpenAI and Anthropic harmed competition in the field.

“New technologies can create new markets and healthy competition. As companies compete to develop and capitalize on artificial intelligence, we must curb tactics that undermine such opportunities,” FTC Chair Lina Kahn said in a press release. “Our investigation will shed light on whether investments And the partnerships promoted by the dominant companies may distort innovation and harm fair competition.”

Although antitrust regulators are often more focused on acquisitions and mergers, the significant investments and deep collaborations between the technology giants and start-ups (andIn particular between Microsoft and OpenAI) prompted the FTC to examine their impact on competition in the field.

As part of the initial investigation, the five companies will be required to hand over to the Commission information such as individual investments and collaborations, including agreements and the strategic rationale behind them; information on the practical implications of the investments and collaborations; and an analysis of their competitive impact, including information on market share, competition, competitors, markets and expansion into new products or regions.

The information will be used by the FTC to conduct studies that will allow it to produce a deeper understanding of market trends and business practices. Findings from these studies could be the basis for further investigations and actions by the Commission.
