The domestic violence case against boxing star Gervonta Davis has been dismissed after both the alleged victim and a key witness declined to cooperate with prosecutors, according to the Miami State’s Attorney Office. The decision brings an end to the legal proceedings stemming from an incident that occurred on Father’s Day.
The 30-year-old Davis was arrested on July 11 following allegations of battery involving his former girlfriend, who is also the mother of his two children. The alleged incident took place on June 15 in Doral, Florida.
Victim Declines to Prosecute
The case was officially dropped because the alleged victim chose not to move forward with prosecution, acting on the advice of her legal counsel. “This case was dropped as the victim is declining to prosecute per her… attorney,” stated a public information officer for the Miami State’s Attorney Office in an email to USA TODAY Sports. The sentiments of the alleged victim were independently verified by the Assistant State Attorney assigned to the case.
Witness Non-Compliance Further Complicates Matter
Further hindering the prosecution was the lack of cooperation from a crucial witness – the mother of the alleged victim. She was subpoenaed to attend a prefile conference on Thursday, August 7, but failed to appear. Subsequent attempts to reach the witness by phone proved unsuccessful.
Adding to the challenges, the responding police officer did not directly observe the alleged incident, effectively eliminating them as a potential witness to the events that transpired.
Bond Dismissed Following Case Closure
With the criminal charge now dismissed, the $10,000 bond previously required for Davis’ pretrial release has also been rescinded, according to the Miami State’s Attorney Office. This concludes the legal chapter, though the situation highlights the complexities inherent in domestic violence cases and the critical role of witness cooperation.
