jpnn.com, KUPANG – The Corruption Crime Court at the Kupang District Court acquitted the defendants of alleged fraud in the use of NTT Provincial Government assets with a build-for-transfer (BGS) or Build Operate Transfer scheme in the form of the construction and management of the Plago Hotel by PT. Sarana Investama Manggabar at Pede Beach, West Manggarai Regency, NTT.

The defendants are Thelma Debora Sonya Bana, Heri Pranyoto, Lydia Chrisanty Sunaryo, and Bahasili Papan. They were acquitted of all charges and legal charges.

“Ordered the public prosecutor to release the defendant from detention,” said Chief Judge Sarlota Marselina Suek at the Kupang District Court, Wednesday (3/4).

The defendants were tried in separate case files. The panel of judges read out the decisions in turn, starting with the defendants Thelma, Heri, Lydia and Bahasili.

The judge also asked the prosecutor to restore the honor and dignity of the defendants as before. Not only that, all evidence confiscated from the defendants must be returned.

Responding to this decision, the defendants’ legal advisor Khresna Guntrarto welcomed the decision of the panel of judges. According to Khresna, this decision was correct and in accordance with legal provisions. Moreover, it is a breath of fresh air of legal certainty for investors who are willing to sacrifice money, time and energy to carry out development using a build-to-transfer scheme.

“Don’t let the criminalization of investors using the BGS scheme happen again. If it happens again, all investors will run away and hesitate to help with government projects,” said Khresna. (tan/jpnn)

The judge acquitted the defendants in the corruption case from all charges and legal demands.
