New Delhi: Quoting the famous dialogue from the film Sholay…’So ja beta, nahi to Gabbar aa jayega…’, the Supreme Court has upheld the decision to stay the release of gangster-turned-politician Arun Gawli. Gawli is serving life imprisonment in a murder case and his premature release was stayed by the Supreme Court in its previous order and now the Supreme Court has upheld its decision.
The Supreme Court had stayed the decision of the High Court
The matter of Gawli’s premature release came before the Nagpur bench of the Bombay High Court. Then the High Court had said in its order on April 5 that the state authority should consider the petition. The High Court had asked to consider Gawli’s application under the state’s 2006 remission policy (policy of premature remission of sentence). This decision was challenged in the Supreme Court. On June 3, the Supreme Court stayed the implementation of the High Court’s decision and postponed the hearing. The bench headed by Justice Suryakant of the Supreme Court, while hearing the case on Wednesday, upheld its June 3 order and said that it is not inclined to give any relief to Gawli and the interim stay will remain in place. The final hearing on the appeal in the Supreme Court will be held on November 20.
‘Gawali has been smoking for 40 years’
During the hearing, the bench said that it should be known that not everyone is Arun Gawli. There is a famous dialogue in the movie Sholay… So ja beta nahi to Gabbar aa jayega. The same is the case here. Ramakrishnan, who appeared on behalf of Gawli, said that Gawli is ill and his health is not good. He is suffering from lung disease. Then the government lawyer said that this is because he has smoked for 40 years. Then Ramakrishnan said what does this mean. Is that why you will keep him in jail. Is this a trial for smoking?
