Thiruvananthapuram ∙ Senior lawyer Kapil Sibal, who is appearing for the state in the gold smuggling case, will be paid a fee of Rs 15.5 lakh by the government to appear in court once. The Law Secretary issued an order in this regard. The fee is to appear on behalf of the state government in the petition filed by the ED seeking to shift the trial of the case to Bengaluru. The Supreme Court will consider the ED’s plea again on November 3.

The decision came in the context of the ED asking for more time for the reply affidavit. The case is being heard by a bench headed by the Chief Justice. Home Department Ad.Chief Secretary Dr. V. Venu approached the court. In July, the ED requested that the trial be shifted to Bengaluru. Sarit, Sandeep and Swapna are the opposite parties in the transfer petition filed by the ED.

The government filed an application to join the case after raising serious allegations against the state government. In the petition, the state pointed out that the ED has not been able to point out sufficient reasons to shift the trial outside Kerala. If the trial is shifted outside Kerala, it will affect the administration of the state. Kerala also pointed out that the credibility of the judiciary will be affected.

The ED had pointed out in the petition filed in the Supreme Court that the state government was trying to subvert the black money case related to the gold smuggling case. However, in the petition filed in the Supreme Court, Kerala stated that even if the allegations leveled against the state government are accepted, it is not a sufficient reason to shift the trial to Bengaluru.
