Government-wide Countermeasures Meeting to Respond to Deepfake Sexual Crimes

The government has recently decided to swiftly pursue a revision of the law to establish new punishment provisions for viewing and possessing fake videos and to raise the standards for punishment for their production and distribution in connection with the spread of ‘deepfake (image synthesis based on artificial intelligence)’ sexual crimes.

On the afternoon of the 30th, the government held a ‘Government-wide Countermeasure Meeting on Responding to Deepfake Sexual Crimes’ at the government complex in Seoul, chaired by Kim Jong-moon, 1st Vice Minister of the Office for Government Policy Coordination.

Officials from ministries related to responding to deepfake issues, including the Ministry of Education, Ministry of Justice, Ministry of Science and ICT, Ministry of Gender Equality and Family, Korea Communications Commission, National Police Agency, and Korean Intellectual Property Office, attended.

The government said, “We have decided to review the progress of each ministry in each field, including investigation and crackdown, victim support, preventive education, and platform management enhancement, and to swiftly and thoroughly implement reporting, education, and investigation currently being promoted by each ministry.”

The government plans to continue inter-ministerial collaboration and additionally collect opinions from private sector experts to create and announce a comprehensive government-wide plan in October.

The first meeting of the day focused on discussing ways to make deepfake sex crimes more realistic.

Following the police’s launch of an intensive crackdown on the 28th, the government decided to review measures to strengthen the prosecution and police investigation personnel and organization and expand undercover investigations.

In addition, it was decided to quickly push forward with the revision of the Special Act on the Punishment of Sexual Violence, which will establish new provisions to punish acts of possessing, purchasing, and viewing fake videos and raise the standards for punishment for the production and distribution of deepfake materials.

In order to protect victims, we decided to review measures to integrate and provide guidance on reporting methods operated by each ministry and to strengthen support for victims, such as deleting false videos and providing psychological counseling.

The Ministry of Education has decided to identify the actual state of damage in schools and provide preventive education in schools so that students can recognize the seriousness of crimes using deepfakes.

The Ministry of Science and ICT and the Korea Communications Commission will promote further commercialization of deepfake production detection technology and strengthen the responsibility and management of information and communications service providers to prevent deepfake videos from being easily produced and distributed and to enable their prompt deletion.

In addition, we plan to cooperate with the National Assembly to swiftly enact and revise related bills, including the currently proposed Basic AI Act, the Information and Communications Network Act Amendment, the Act on Special Cases Concerning the Punishment of Sexual Violence, and the Act on the Prevention of Sexual Violence.
