The court finds it not proven that the doctor also caused the death of the girl. “We do not know when the fatal complications arose and how they progressed. There is insufficient medical data for this. But it is certain that the lack of research has exacerbated the girl’s situation.” The court therefore found the doctor guilty only of unintentional blows, but she received a suspended sentence for that.
The court took into account, among other things, her clean criminal record, sincere involvement, the professional impact that a sentence would have and the time since the facts. If she makes a serious mistake again in the next three years, a punishment can still be imposed.
