Düsseldorf – Green instead of gray, wind instead of calm – NRW is revising the state building code and the plans have implications for both existing and new builds.

Gravel gardens are already banned in the country. Instead of sealed areas, plants must dominate the front and back gardens. The existing ban is now even tightened. According to this, the construction supervision could even order the dismantling of stone deserts, said NRW Construction Minister Ina Scharrenbach (46, CDU).

What does politics have against the gray gardens?

Quite simply, they are bad for the environment. Because more and more heavy rain events are occurring, garden areas must be able to absorb the water. It requires the seepage areas.

Another aspect: The stone deserts also heat up the area and are bad for the biodiversity of fauna and flora.

︎ The draft law also sees one simplified procedure for wind turbines before, for which only the so-called EU Machinery Directive should apply as a specification in building law. Specifications that go beyond EU law should no longer be required by building law in NRW in the future.

▶︎ For heat pumps the minimum distances to neighboring properties under building regulations are to be abolished. BUT: The noise effects on the neighborhood must still be taken into account.

︎ For new non-residential buildings, a Solar system obligation apply, for new residential buildings then one year later. The date of receipt of the planning application is decisive.

In addition, more roof area should be usable for solar systems in the future. The half-meter step area for the fire brigade is to be deleted.

▶︎ Smaller plants for the production of hydrogen should not be subject to building law, but should be “process-free” if the hydrogen is used for self-consumption. This also applies to gas storage tanks with a volume of up to 20 kilograms.

︎ The draft law provides for several simplifications building permit process before. The simplest: building applications should in future be able to be submitted as an email and no longer just in paper form in multiple versions. The conversion and conversion of older buildings should also be simplified.
