Dusseldorf A previously kept secret investigation report by the law firm Clifford Chance fuels doubts about the seriousness of the Hamburg public prosecutor’s office in the fight against tax evaders. In November, the parliamentary committee of inquiry in the Hanseatic city wants to start examining HSH Nordbank’s cum-ex transactions. The former Landesbank was privatized in 2018 and now operates as Hamburg Commercial Bank (HCoB). Her cum-ex legacy was never cleared up.

According to information from the Handelsblatt, the investigative committee has a 450-page report with the project name “Saturn”. “The report shows very precisely how HSH Nordbank did cum-ex deals,” says Norbert Hackbusch, who sits on the committee of inquiry for the left. “It is puzzling why the Hamburg public prosecutor’s office did not initiate any investigations.”

The prominent Hamburg criminal lawyer Gerhard Strate put it more sharply: “It is unbelievable that there was never a procedure in this matter. The complete inaction of the Hamburg public prosecutor’s office in this case should meet the criteria of frustration of prosecution in office.”
