The showdown has only just begun. The deliberation delivered this Monday afternoon announces a new pass of arms between Clermont and Mohamed Haouas. The Auvergne club has indeed been dismissed by the industrial tribunal of its request for cancellation of the contract of the international pillar from Montpellier, which takes effect from July 1.
If the court considers the request “admissible”, it finds it “unfounded”, according to the newspaper The mountain. It therefore condemns the ASM to €800 under Article 700 and to legal costs and expenses. On the other hand, it dismisses Mohamed Haouas, sentenced to one year of flexible prison for acts of domestic violence on May 30, of his request for damages for abusive procedure.
As soon as the 29-year-old international pillar was sentenced, the Auvergne club announced that it wanted to cancel the contract signed for three seasons. Clermont had then launched a procedure on the merits, initiated for lack of consent. “It is clear that the ASM did not have when signing the contract, all the useful information on the qualities of the player, and was not aware of important facts concerning him”, explained the lawyer of the ASM, Patrick Puso. The employment contract will therefore not be suspended and the player will be present in Clermont, according to his lawyer, for the resumption of training on July 1, accompanied by a bailiff.
Dismissal or transaction?
It then remains to find a way out of a situation that cannot remain as it is. According to master Gallix, one of Mohamed Haouas’ lawyers, we must expect negotiations with a view to breaching the contract because “it is not possible for a single moment that he is playing in a club that does not do not want. There, he might earn some money but he would definitely ruin his professional career. Two solutions then exist: either the dismissal procedure if the player’s behavior constitutes serious misconduct, or an agreement on a transaction that would satisfy both parties. Mohamed Haouas could then engage elsewhere. He would have already received proposals from several clubs according to his advice: “one from the top 14, two from Pro D2 and clubs who want to go back to the Top 14”. Agen and Biarritz would be in the running, according to master Gallix.
“Mohamed is committed to solving his problem of violence”, added his lawyer, this Monday morning, after the passage before the judge of the application of the sentences at the judicial court of Montpellier. “We are going to make a request for parental parole,” he said after the closed meeting. The other possibility is the installation of an electronic bracelet which is more restrictive insofar as it will be difficult to play rugby with it.
