After 650 lockers were broken into in August 2021, the Sparkasse and those affected are still arguing about compensation. Now a Hamburg court has ruled for the first time.

Anyone who wants to keep valuables, important documents or just immaterial mementos safely stored usually rents a safe deposit box in the rooms of a bank. The demand for it is great, the number of free subjects has been scarce for years, also because there are fewer and fewer branches. However, the fact that this type of protection is by no means as secure as thought is shown by the spectacular break-in of around 650 lockers in a branch of Hamburger Sparkasse (Haspa) around two years ago. At the weekend, the burglars came through the ceiling from an apartment above the vault with heavy equipment – the confusion and anger of many customers was great. The dispute over compensation from Haspa continues to this day, and some of it is being resolved in court.

The Hamburg Regional Court has now largely upheld the claims of three affected customers in the legal dispute over compensation payments for the break-in into the vault of the Haspa branch in Norderstedt in August 2021. According to the verdicts announced a week ago on Thursday, Haspa is liable to customers for damages for the stolen contents of the broken open lockers, since the security measures taken for the locker system were insufficient compared to the obligation to “safety-wise security”, says Kai Wantzen, spokesman of the Hanseatic Higher Regional Court, the FAZ According to these decisions, the savings bank cannot invoke the maximum liability limit of 40,000 euros, which is contained in the contractual conditions for lockers. According to the wording of the clause, it is already unclear for which situation this maximum amount should apply. In any case, these are invalid as general terms and conditions.
