Almost ten years of proceedings… Stéphane Labarre said he was exhausted during his last appearance before the Limoges administrative court. Since he moved his pharmacy from the town center of Nexon, a town in Haute-Vienne, to the parking lot of a Super U in 2014, he has lived through the procedures initiated by colleagues who are attacking the transfer of his pharmacy. According to them, there are too many pharmacies in the same sector based on demographics. This December 12, the Limoges administrative court once again went their way by annulling the decree of September 8, 2021 by which the Nouvelle-Aquitaine Regional Health Agency authorized this transfer. Which means it risks closing again…

It would not be the first time. On four occasions already, Stéphane Labarre had to close, was authorized to reopen, before closing again. On May 19, 2021, his new transfer request was accepted by the Regional Health Agency. Olivier Thenaille, head of legal affairs for the ARS, spoke of “the real usefulness of this pharmacy in terms of public health. What is at stake here is the question of medical deserts. »

But two pharmacists challenged this transfer authorization and have once again won the procedure. The court notes that the transfer of the Labarre pharmacy is not justified in view of demographic developments and does not correspond to the needs of a new population in the sector.

According to the magistrates, the population in the district concerned, established at 578 inhabitants in 2019, and that of neighboring municipalities without a pharmacy are already served by pharmacies in Nexon, La Meyze and Ladignac-le-Long. It is therefore impossible to justify the establishment of the Labarre pharmacy at Super U, where it would possibly have “siphoned off” the patient base of its competitors.
