3/2002 on the minimum level of occupational health and safety requirements for workplaces contains specific rules for the requirements of healthy and safe work. It is fixed by a joint decree of SzCsM-EüM.

Based on this, the temperature of the rooms containing the work areas must be suitable for the human body during the entire duration of the work, taking into account the nature of the work and the physical strain of the employees working there. In addition, rest areas, rooms for personnel performing various duties, medical facilities, canteens and first aid stations must also ensure the appropriate temperature for the purpose of such rooms.

The decree also stipulates that windows, skylights and glass walls must be used that eliminate the effects of strong solar radiation in accordance with the nature of the work and the workplace. And in closed workplaces, depending on the nature of the work performed and the seasons, a temperature (climate) that also takes into account the degree of difficulty of the work must be provided. The employer is also obliged to ensure that the employee is not exposed to a high degree of heat radiation – they warn on the portal.

Measures that the employer is obliged to take

After starting work at workplaces with heat effects above 24 °C, and in the case of re-employment after a break of more than three weeks

the conditions for heat adaptation must be ensured through work organization.

To this end, the duration of the daily heat exposure at the beginning of the adaptation process should not exceed 2 hours. The load level associated with the given job must be gradually reached within 2 weeks. At workplaces considered to be hot, workers must be provided with a protective drink as needed, but at least every half hour. Fluid loss should usually be replaced with drinking water at a temperature of 14–16 °C. A flavored, alcohol-free drink at the same temperature is also suitable for this purpose, the sugar content of which does not exceed 4% by weight of the drink, or which is flavored with artificial sweeteners. For the consumption of the protective drink and tea, at least the number of drinking glasses for each person and for individual use must be provided.

Aspects to watch out for

It should be noted that the regulation does not specify the “normal” temperature when determining the temperature, so its examination requires special equipment and expertise. In addition, with regard to the mandatory rest period, it is worth bearing in mind that it is not considered a break between work according to the Mt. .

An important circumstance is that this break cannot be worked with the employee.
