As the High-ranking Public Officials Crime Investigation Agency (Corruption Investigation Office) failed to execute an arrest warrant for President Yoon Seok-yeol, who is suspected of being the leader of the rebellion in connection with the 12/3 martial law incident, attention is focused on the direction of the investigation. While various possibilities are being discussed within the Corruption Investigation Office, such as re-executing and re-issuing arrest warrants and requesting arrest warrants, the fact that securing President Yoon may not be secured is considered a variable.
In the legal world, there is a prediction that the Corruption Investigation Office will execute again as early as the 4th, as the arrest warrant expires on the 6th. Although the Corruption Investigation Office failed to arrest President Yoon on the 3rd, three prosecutors succeeded in breaking through the first and second barriers and approaching the ‘third line’ at the entrance to the official residence, meeting with the defense team for the first time and presenting an arrest warrant. There is also an opinion within the Corruption Investigation Agency that “we can succeed if we try one more time.” If the arrest warrant is successfully re-executed, the Corruption Investigation Office plans to investigate President Yoon at the Gwacheon City Hall in Gyeonggi Province, detain him at the Seoul Detention Center, and then request an arrest warrant.
However, the Presidential Security Service is desperately trying to block the execution by building a ‘human shield’, raising the prospect that even if it is executed again, it will ultimately be impossible to secure new recruits. The Presidential Security Service made it clear through a statement on the 3rd that it had no intention of responding to the execution.
An arrest warrant may be requested again after 6 days, which is the deadline for the arrest warrant. However, since it is certain that President Yoon will not respond to the Corruption Investigation Office’s investigation, the option of immediately requesting an arrest warrant is also being discussed. If the Corruption Investigation Office requests a preliminary arrest warrant without investigating the suspect, President Yoon will be subject to a court review of the warrant. It is known that President Yoon is willing to appear in person if a warrant review is held. If the court issues an arrest warrant after the warrant review, President Yoon will be immediately imprisoned in the Seoul Detention Center and investigated by the Corruption Investigation Office. After the investigation, if the Corruption Investigation Office transfers President Yoon to the prosecution, the prosecution will indict him. The Corruption Investigation Office and the prosecution have agreed on a total detention period of 20 days, so the Corruption Investigation Office and the prosecution can investigate President Yoon for about 10 days each.
However, if President Yoon does not appear at the substantive warrant review and refuses to be recruited, the Corruption Investigation Office may continue to face difficulties in securing new recruits. For this reason, a plan is being discussed where the Corruption Investigation Office transfers President Yoon to the prosecution without investigating the suspect, and the prosecution immediately indicts him. A situation may arise where both the Corruption Investigation Office and the prosecution are unable to investigate President Yoon and instead hand him over to trial.
