Apart from this, a fine of up to Rs 5 lakh will also be imposed. This also includes tampering with the copy, award sheet, number register, mark sheet etc. To prevent cheating, paper leak in public examinations and take action against those involved in it, this has also been included as a serious crime in the UP Public Examination (Prevention of Unfair Means) Ordinance. After the permission of the Governor, the notification of the law has been issued. Now action will be taken in cases related to paper leak only under the new law. In view of the increased incidents of paper leak in recruitment examinations, the Yogi government has made the scope of the new law very strict. Every machinery related to the examination system has also been included in its scope. If the paper is leaked due to deliberate negligence of any responsible person associated with the conduct of public examinations in the state or the examination is affected due to the possibility of leak, then he will also be jailed for 2 to 7 years.

The candidate will be debarred

The definition of solver gang also includes solvers who sit in someone’s place and appear in the exam. However, if a candidate is found using unfair means in the exams being given for academic, technical, professional or other qualifications, he will not be jailed. He will be debarred. However, he will not be barred from appearing in competitive exams.

Why was the law made stricter?

The UP law to prevent paper leak in competitive examinations is much stricter than the central law. The definition and scope of the crime has been expanded. The officers and employees associated with the examination authority and their negligence are also a part of the punishment. This exercise of the Yogi government is not without reason. Paper leak in police recruitment, UPPSC and some other examinations has affected the future of the youth. The credibility of the government and examination regulatory bodies has also been badly affected by this. The number of youth participating in recruitment examinations is so high that if the examination is affected, its impact is very widespread. The social and political impact of the anger arising from the paper leak has also been visible. Therefore, the government has decided to take strict steps to maintain the core agenda of purity and transparency and the trust of regulatory bodies. This will reduce the possibility of paper leak in future examinations. Bringing regulatory bodies also within the scope of punishment for irregularities will also increase vigilance and accountability.

The scope of punishment will remain like this

2 to 10 years imprisonment, fine up to Rs 5 lakh
– A person connected with the exam opens the question paper before time at the exam centre and leaks it or gets it solved
– Provides any information related to the exam which may affect the exam
– Enters the exam centre illegally and helps the candidate
– Gets the copy written at some place other than the examination centre
– Influencing the result by manipulating the evaluation of copies or mark sheets

3 to 10 years imprisonment, fine up to Rs 10 lakh
– Officials and employees of the examination authority or the institution connected with the work of examination adopt unfair means
– Any person in collusion with the solver gang prevents any person connected with the examination from doing any work by threatening, luring or in any other manner which may affect the examination

7 to 14 years in prison, fine up to Rs 25 lakh
If any employee of the examination authority or institution is a part of the solver gang
– Solver gangs collude to influence the exam by threatening and luring people associated with the exam
– There is a solver gang which leaks the paper, gets it solved, and creates disturbances by setting up the centre

Life imprisonment, fine up to Rs 1 crore
– Solver gang caught again for paper leak or influencing exam
– Affects the examination by threatening the life of any person associated with the examination authority or by taking him hostage
