The changes in the laws also tightened the responsibility of employers – it is expected that the managers of the institution, when employing persons whose activities are related to children, will have to check the aforementioned QR code. Such inspection will have to be repeated periodically – at least once a year.
The control of the procedures will also be supervised by the responsible institutions – the Child Rights Protection and Adoption Service and the State Labor Inspectorate will be able to check at any time how employers comply with the obligation provided for by the law. The Department of Social Services Supervision will ensure control in social service institutions, companies and organizations. In turn, the National Education Agency will be responsible for educational and sports institutions, and the State Accreditation Service for Health Care Activities will be responsible for the health care sector.
Administrative liability is also provided for non-fulfilment of established duties. If the employer does not check a person’s QR code before hiring him or once a year, he will face a fine of 300 to 500 euros.
For repeated violations, the fine will increase from 500 to 1 thousand. euros. A larger fine is provided in the event that it is determined that the activity is carried out by a convicted person – from 3 thousand. up to 5 thousand euros, and if such a case is determined again, the fine would amount to 5 thousand. up to 6 thousand euros.
100 parliamentarians supported the amendments to the Basic Law on the Protection of Children’s Rights providing for the aforementioned changes, one voted against, and there were no abstentions. The changes in the law will enter into force from 2024. November 1
