Murugesan, a resident of Pennalur village in Sriperumbudur taluka, Kanchipuram district, had filed a case alleging that the church was built by occupying the road leading to the cemetery and the outlying land of Maykal.

In the reply petition filed by the Sriperumbudur Dashildar in this case, it was stated that there was no objection to the construction of the church and that the church was not built by occupying the path. In the order issued by the trial judge SM Subramaniam, without any details, he condemned the waiter who had filed a reply in favor of the builder of the church.

Further, the judge questioned whether the state could be allowed to occupy the lands in the absence of objections and advised that the occupiers should take steps to remove them wherever they are and be vigilant to protect the state property.

The judge said that if the church was to be built, the appropriate building permit and the permission of the district attorney would be required, and ordered that the church involved in the case be demolished within four weeks as it was being built without any permission.

Further, the judge ordered the district attorney to conduct an investigation and take action against the plaintiff who filed the counter-petition without any details in order to conceal the factual information, and ordered the district attorney to take immediate action against the occupiers if they built illegal places of worship.
