An illegal Venezuelan immigrant who shot and wounded a police officer in San Antonio, Texas, on Sunday was set to be deported after entering the United States last year, but an immigration judge gave him a second chance to stay in the country, a Homeland Security source revealed to The Post.

According to the source, suspected police shooter Jorge Chacon-Gutierrez, 25, crossed the southern border with a group of about 600 migrants in November 2023.

At the time, border agents were processing him for “expedited deportation”, but he argued that he feared persecution in Venezuela, so he appeared before an asylum officer, who denied his request and continued processing him for deportation.

However, Chacon-Gutierrez asked to present his claim before an immigration judge, who immediately rescinded his deportation order and allowed his case to continue.

The case highlights how the U.S. immigration system has “so many flaws,” the source said.

Chacon-Gutierrez was allegedly involved in a shootout with police who were responding to a domestic violence call in the early morning hours before he died, police said.
