This is one of the points of contention in immigration law. This Thursday, MPs voted for a compromise on the regularization of undocumented immigrants in professions in shortage.

“We are resolutely opposed to the provisions of the article,” declared MP Annie Genevard on behalf of the LR deputies, who voted against. This new version does not create either a “discretionary” procedure at the discretion of the prefect, as the senators wanted, nor an automatic right to regularization, defended the general rapporteur of the text Florent Boudié (Renaissance).

“We want to regularize people who work”

The article of the immigration bill relating to the creation of a residence permit for professions in shortage will retain modifications from the Senate and will not return to its initial version, but must still be subject to “improvements”, Gérald Darmanin had judged earlier this Thursday.

“The National Assembly proposed (in committee: editor’s note) to modify the Senate text” and “I will support these improvements, because we want to regularize people who work, who are honest,” declared the Minister of the ‘Interior on France 2.

“The proposal made by the general rapporteur of the National Assembly Florent Boudié (…) is to modify the Senate text”, but “not to return, to respect the Senate, to the initial article of the government” , he added.

Florant Boudié tabled a “compromise” amendment this week: the system will be neither a “discretionary procedure” (in the sole hands of the prefect), nor “an automatic right to regularization” (the prefect can object to it in certain conditions), details its explanatory statement.

“Prefects could oppose regularizations because, for example, the person has a criminal record. With a very simple philosophy: it is better to regularize the nanny who works, the waiter, the construction guy who works rather than leaving foreign delinquents on our soil,” explained the Minister of the Interior.
