In Paris, 20% of rents still do not comply with the regulations

Rent control, which limits the increase in the amount of rent that an owner asks of his tenant, is starting to be increasingly respected in the capital, according to the study by the Consumption, Housing and Living Environment association ( CLCV), which relies on advertisements specifying the rent excluding charges and not applying any additional rent, being unable to verify the legitimacy of this system. Paris achieves a score for compliance with the system never before obtained: 77% of the 1,000 advertisements studied between October 2022 and August 2023 comply with rent controls, up 8 points compared to the previous year. And this for bare rentals as well as furnished rentals. Has rent control become a common practice since its application in 2019?

«We see very clearly that the situation in Paris is improving, the health crisis has had an impact and led to the need to reduce rents. 40% of illegal ads in Seine-Saint-Denis

Conversely, Seine-Saint-Denis (93) appears to be a bad student: 60% of the 800 advertisements respect the rent control, a correct result but which has stagnated since 2021. This means that 40% of the advertisements are illegal compared to 23% in Paris. “An evolution that resembles that of Paris. Rent control in Seine-Saint-Denis is more recent, it was put in place two years ago», Comments David Rodrigues.

This department should therefore follow the same trajectory as that of the capital. “This shows that the health crisis and the sanctions are not enough to explain the proper application of rent controls. It is necessary for everyone to take ownership of the system, professionals, landlords and tenants.», Explains the study. The gap in good practices between unfurnished rentals and furnished rentals is, moreover, very marked: there is a 20 point difference between advertisements for furnished rentals which comply with rent regulations (48%) and advertisements for compliant bare rentals (68%). Among the 1,800 advertisements studied in these two departments, 69% respect rent controls and almost a third are illegal.

The CLCV also criticizes rental platforms between individuals: 42% of illegal advertisements recorded on Leboncoin, 40% on Bien Ici, 36% on SeLoger and 22% on the National Real Estate Federation, Fnaim. “Leboncoin has not updated its site to encourage lessors to mention mandatory information in an ad», laments David Rodrigues. In particular, on these sites it notes ratios per m² instead of the exact amount of the increased reference rent mentioned. Foncia with 5% of non-compliant announcements, Century 21 (9%) and PAP (13%), are good students.
