In the verdict announced yesterday, the Constitutional Court (ST) recognized as conforming to the Constitution the norms according to which the content of general education in private educational institutions must be learned in the national language. The court emphasizes that the state must promote and strengthen the use of the Latvian language at every level of education, so that it can effectively fulfill the functions of the state language.

The court points out that the skills of the national language play a vital role in ensuring personal rights and building a cohesive society. On the other hand, private educational institutions have wide freedom of action to provide content related to minority identity, among other things, within the framework of interest education.

The disputed provisions of the Education Law determine the acquisition of education in private educational institutions only in the state language. The applicants – students who identify themselves with a national minority living in Latvia – believe that the contested norms do not comply with the right to education defined in Article 112 of the Constitution, the right of persons belonging to national minorities to preserve and develop their linguistic, ethnic and cultural identity, defined in Article 114, as also to the principle of protection of legal expectations contained in Article 1.
