Poupette Kenza, one of the most followed influencers in France on the social network Snapchat, was sentenced to a criminal fine of 50,000 euros for “deceptive commercial practices”, announced Tuesday, November 28, the Directorate General for Competition, Consumer Affairs and Fraud Control (DGCCRF). The company Seyana Society of Poupette Kenza, whose real name is Kenza Benchrif, was inflicted with this sanction for product placements including “the true commercial intention” was not sufficiently explicit, as well as for the promotion of a “teeth whitener”presented as legal “even though it is prohibited for sale on French territory”.

The announcement of the conviction of the influencer with 1.6 million subscribers is not a surprise: she herself publicly declared in August that she had received a letter from the DGCCRF informing her of the reproaches which were made to him. In addition to the fine which she must now pay, the Rouennaise is required to broadcast a press release about her sanction on her social networks Instagram, TikTok and Snapchat, the DGCCRF then ordered her in its letter. At the time, Poupette Kenza announced her intention to oppose her conviction.
The amount of the sanction is much higher than that which Nabilla had to pay, sentenced in July 2021 to a fine of 20,000 euros, also for “deceptive commercial practices” on Snapchat. But the practices of influencers are now more strictly regulated: since the beginning of June, the DGCCRF has issued several injunctions against some of them, alongside the adoption by Parliament of a text regulating their practices. The latter also prohibits the promotion of certain things, such as cosmetic surgery or “therapeutic abstention”. It prohibits or severely regulates the promotion of several medical devices. The penalties provided for in the event of non-compliance are up to two years in prison and a fine of 300,000 euros.
