Adopted unanimously at first reading at the end of March by the National Assembly, this transpartisan text, supported by Bercy and the Minister of SMEs Olivia Grégoire, gives a legal definition to influencers and prohibits certain practices, such as the promotion of cosmetic surgery.

The rapporteur of the text in the Senate Amel Gacquerre (centrist) proposed to also prohibit the promotion of therapeutic abstention, nicotine-based products, in particular nicotine sachets whose sale on the Internet is developing among adolescents, or still subscriptions to sports betting predictions. For the rapporteur, it is a question of “further protecting, particularly the young public”.

Reinforced penalties

The senators made a point of recalling that the existing rules on advertising and promotion already apply to influence marketing.

They have increased the penalties applicable if advertising bans are not respected or if an influencer conceals the true commercial intention of their publication, which would now be clearly indicated by the mention “Advertising”: up to two years of imprisonment and 300,000 euro fine.

They also adopted an amendment by Laurent Duplomb (LR) removing the ban on minors under the age of 16 from promoting foods or drinks that are too sweet, salty, or containing too many synthetic products, which had been debated. in the National Assembly.
