With a decision issued by the Single-Member Court of First Instance of Rhodes in the interim measures procedure, the application of a resident of Rhodes against a local resident was also accepted and he was temporarily prohibited from approaching her and her house at a distance of less than 100 meters and from communicating with her by phone, text or any other means.
With the same decision, he is threatened with a fine of €500 in favor of the applicant as well as personal detention of 3 days for each violation of the previous provision.
The parties, from approximately the end of 2017 until August 2020, maintained a romantic relationship, during which they lived together for certain periods.
However, this relationship did not develop smoothly, there were tensions and verbal episodes, culminating in the episode of August 16, 2020, for which he was referred after a complaint by the applicant before the Three-member Misdemeanor Court of Rhodes to be tried for the acts of domestic threat, domestic genital insult dignity and weaponry.
Afterwards, the applicant moved to her daughter’s house, but the defendant continued to harass her by insulting and threatening her, as a result of which she made a relevant complaint against him to the AT Ialyssos on November 24, 2023 for the acts of insult and of the threat.
However, this behavior continued until April 2022, when the phone calls stopped.
The applicant claims that this is the result of his call for recommendations from the AT. Rhodes, but this was not assumed by the court.
From September of the year 2022, the applicant again started to receive abusive and threatening phone calls from the defendant and even from different phone connections, since she did not answer the calls coming from his phone, and she was forced to contact AT . Rhodes on November 23, 2022 and to make a relevant complaint, while he immediately filed the request for injunctive measures.
It was judged that the above persistent, insulting and threatening behavior of the defendant is likely to have caused her fear, anxiety and worry, and constitutes a reduction in the value of disturbing her mental peace and sense of security.
It was also possible that the defendant’s behavior constitutes an illegal insult to the personality of the applicant, and there is an immediate risk that this will be repeated in the immediate future, given that neither the motion against the criminal proceedings nor the repeated summons of from the police authorities were able to prevent him.
