Intentional corona infection? The public prosecutor declined to appeal

IIn the trial against a 72-year-old woman who is said to have met and infected an acquaintance in spring 2020 despite positive corona tests, the public prosecutor withdrew her appeal to the Darmstadt Regional Court on Tuesday. The public prosecutor justified his decision by saying that the evidence was too thin. Ultimately, the accused could not be proven with certainty that she left her apartment after receiving the notification of the positive test result.

The public prosecutor had previously accused the accused of visiting an acquaintance in his apartment in Seligenstadt on March 25, 2020, although the health department had informed her of her corona disease by telephone shortly beforehand. Shortly thereafter, the man tested positive for Corona and died in hospital around three months later.

“She runs around with Corona and infects people”

In front of the Darmstadt Regional Court, the daughter of the deceased said that her father called her from the hospital and said: “She runs around with Corona and infects people”. She then informed the police, according to the 41-year-old woman. Another witness, who is said to have been present at the meeting in question in March, stated in court that the accused had shown cold symptoms days before. He made varying statements to the court about the exact time and other details of the meeting. A neighbor of the accused, who was also called as a witness, assured that the accused did not leave the house after the health department called.

Due to the “very credible” account of the neighbor and partly contradictory statements by the previous witnesses, the public prosecutor finally withdrew their appeal.
