BIn the past, authorities needed solid facts or the well-founded suspicion of a breach of law in order to carry out such monitoring and to collect the corresponding data. However, this threshold has been drastically lowered in recent years. Because the Internet in particular is increasingly seen as a “legal vacuum” on which the state wants to exert greater influence. But how is that supposed to be implemented at all?

There was the introduction of the NetzDG (Network Enforcement Act), a law that required social networks like Facebook, Twitter and YouTube to ban types of unlawful content such as hate speech, hate speech, insults, threats and other criminal content within 24 hours of receiving a complaint to delete or block. Incidentally, according to a Danish study, the law was adopted almost identically by at least 13 autocracies.
