¿Telcel is a monopoly? The Federal Institute of Telecommunications (IFT) issued a sanction against Carlos Slim’s company for such practices in 3 states of the country.

IFT imposes sanctions on Telcel for monopolistic practices

The plenary session of the IFT resolved that Telcel incurred in monopolistic practices in 3 states of the country, as established in articles 54 and 56, section VIII, of the Federal Law on Economic Competition.

Consequently, the autonomous body resolved that Carlos Slim’s company must comply with the payment of a millionaire fine which is close to 100 million pesos.

Through a statement, the IFT announced that the sanction against Telcel for acting as a monopoly in 3 states, derives from an investigation that began in January 2021.

Regarding the practices in which the company incurred, the authority indicated that it granted and offered discounts, incentives and benefits, in exchange for harming to another company in the same field.

In particular, it was discovered that Telcel offered such benefits under the requirement not to sell packages of cell phones with SIM cards and cheap recharges to rival companies.

Regarding such conduct, the IFT pointed out that the investigation was able to document that it took place in three states of the country: Michoacan, Colima and Jalisco.

“This conduct affected consumers, as it restricted their options for purchasing mobile terminal equipment and SIM card packages, as well as for recharging, from providers other than Telcel.”

How much is the fine that the IFT imposed on Telcel?

Informing that it was resolved sanction Telcel for behavior typical of a monopoly in 3 stateshe IFT He stressed that the company must pay a total of 90 million 659 thousand 701 pesos.

On the other hand, the statement details that The sanction is the result of an investigation which was initiated by the Institute’s Investigative Authority during the month of January 2021.

The investigations into the case, it is noted, gave rise to the issuance of a Probable Liability Opinion by the same authority in November 2023.

Through this ruling, the IFT summoned Telcel to the procedure followed in the form of a trial, in which it had the opportunity to fully exercise its Guarantee of hearing and opportunity for defense.

In this regard, the IFT concluded that the resolution and the subsequent sanction against the Carlos Slim’s companywas ruled on based on its economic competition powers.
