The judges of the National Court of Justice (CNJ), Iván Saquicela, Julio Inga and Manuel Cabrera, declared inadmissible the appeal for cassation filed by the defense of José Carlos Tuárez, who has been in the Quito Prison since August 2020, after being found guilty as the direct perpetrator of the crime of illicit association.
A criminal court of the National Court of Justice (CNJ) declared, on July 22, 2024, the appeal for cassation raised by the defense of José Carlos Tuárez, who remains in Prison 4 of Quitosince August 2020, after being found guilty as the direct perpetrator of the crime of criminal association.
Cassation is a legal remedy that seeks to challenge a court ruling and ask a higher court (the CNJ) to review and correct errors committed by an appellate court. With the cassation, Tuárez sought to be released from prison.
That year, the Prosecutor’s Office stated that the religious man took advantage of his position at the head of the Council for Citizen Participation and Social Control (Cpccs), to offer public positions in State entities, such as the General Directorate of Civil Aviation, the National Customs Service, in exchange for $5,000 to $20,000.
In August 2020, a Court of Guayas sentenced him to five years in prison for criminal association, and in January 2021 the sentence was ratified.
In their ruling today, CNJ judges Iván Saquicela (rapporteur), Julio Inga and Manuel Cabrera, when justifying the inadmissibility of the appeal, explained that they found no errors of law in the judgment issued by an appeal court. (SC)
