Judge Appio admits ‘improper conduct’ and withdraws from Lava Jato court

In an agreement reached during a conciliation hearing, judge Eduardo Appio, 53 years old, admitted having maintained “improper conduct” in command of the 13th Federal Court of Curitiba and gave up on resuming the role, previously occupied by his enemy, Sergio Moro.

The judge also agreed to give up returning to the Court and thus apply for a notice to be transferred to another location, according to a newspaper report Folha de S. Paulo.

The National Council of Justice (CNJ) held this Wednesday, 18th, the conciliation hearing between Appio and the Federal Regional Court of the 4th Region (TRF-4).

Appio’s threats

The magistrate was removed from the 13th Court by the TRF-4 after the complaint that he called the son of judge Marcelo Malucelli pretending to be someone else.

Appio threatened him, referring to confidential data. The judge then began to respond to an administrative proceeding.

Malucelli’s son is Sergio Moro’s partner and son-in-law. Before his removal, Appio was responsible for the remaining Lava Jato processes.

The hearing was mediated by the national inspector of Justice, minister Luis Felipe Salomão, and was attended by judges Fernando Quadros da Silva, president of the TRF-4, and Vânia Hack de Almeida, regional inspector of the Federal Court of the 4th Region.

According to a report from Sheet, the TRF-4 judges wanted Appio to admit that he made the phone call. But, in the agreement, he only admitted “inappropriate conduct”, without saying whether or not he called Malucelli’s son.

In order not to lose his position as judge, Appio agreed to give up returning to the 13th Court.

Toffoli support

On September 19, the Minister of the Federal Supreme Court (STF) Dias Toffoli had suspended Appio’s removal and also the progress of the administrative process against him.

This way, the judge would be able to return to the 13th Federal Court. However, the following day, Inspector Salomão maintained his suspicions. Two days later, the inspector scheduled the mediation hearing for this Wednesday, the 18th.

In favor of Lula

Appointed head of the 13th Criminal Court of Curitiba at the beginning of the year, Appio is against second-instance arrest and believes that the arrest of President Luiz Inácio Lula da Silva caused “irreparable damage”.

He questions what he considers “excesses” committed by the extinct task force.

In May, Appio admitted that he signed in the Federal Court’s electronic system as “LUL22“, in reference to Lula’s presidential campaign in 2022.

Appio stated that the signature was a protest against the PT member’s arrest. He is openly critical of the performance of Sergio Moro and Deltan Dallagnol.

The judge said he intended to erase the entire legacy of Operation Lava Jato, based on a case of an alleged wiretap in the cell of money changer Alberto Yousseff in 2014.
