The courtroom of the Coyah Court of First Instance served as the setting on Thursday, July 4, 2024, for the delivery of the authorization documents of the OPJs of the police and the gendarmerie of the Coyah prefecture.
In accordance with the Code of Criminal Procedure, these agents receiving these acts of authorization from judicial police officers will be authorized to exercise this function in complete honesty and without pressure.
The prosecutor of the court of first instance of Coyah, Mamady Lazarre BAURET wanted to clarify for the occasion: “These judicial police officers will be able to work in equality since a judicial police officer whatever the rank if he is not authorized by Mr. the attorney general, he cannot exercise the activities of the judicial police officer. That is to say, he cannot keep someone in custody, he cannot send a report. If he did it out of ignorance or by extraordinary, he exposes himself to the rigor of the law and could be prosecuted not only for facts of arbitrary arrest and the acts and reports that he draws up could be canceled in the hearing phase. “
Further, he explains: “From the moment they are authorized, they expose themselves to the rigor of the law and it is not a service that is authorized, it is each judicial police officer taken individually who has received from the hand of the attorney general his authorization act. Any failure to fulfill his duty in the exercise of this function exposes him to disciplinary sanctions but also to legal proceedings”, will say the prosecutor near the court of first instance of Coyah.
Presiding over this handover ceremony, the representative of the Attorney General, Falou Doumbouya, Ousmane Sané, Attorney General at the Court of Appeal of Conakry hammered home: “These enabling acts are one of the essential conditions for a judicial police officer to be able to fully exercise his activity, this is in accordance with the code of criminal procedure. Any judicial police officer who is not authorized will not be able to carry out a procedural act.”
Further, he specifies: “Even if you are authorized, in order to carry out this activity, you would have to be assigned to an investigation service. If you are authorized and you are not assigned to an investigation service, it is because your authorization is suspended until the time when you are reassigned to an investigation service,” the attorney general will say.
It should be recalled that now in the prefecture of Coyah there are 163 judicial police officers (police and gendarme) who will receive their authorization certificates for this year 2024 and who will be the only ones authorized to conduct an investigation on behalf of an investigation service.
