After the ÖVP published chat messages about alleged judiciary post-hunting, the Supreme Court (OGH) repeated its request to obtain proposals from an elected judiciary when filling its presidents and vice-presidents. According to “Presse” (Saturday edition), OGH President Elisabeth Lovrek also announced “consequences” for Vice President Eva Marek.

The matter should “not be passed over,” Lovrek said through a spokeswoman, the newspaper writes. The consequences of this should be decided on Monday after a conversation with the person concerned.

In any case, the Supreme Court is demanding consequences for the appointment of posts: the allocation based on a proposal by the staff senate would bring more transparency, and this would be in the interest of everyone involved and would be a gain for the rule of law, it said in a statement. The suggestion of such an independent body consisting of judges who are not bound by instructions would already avoid the appearance of influencing the filling of important positions. The demand for such a change in the law has been around for a long time, and the Ministry of Justice has repeatedly been asked to do so.

Angry message to the Attorney General

The online portal “ZackZack” by publisher Peter Pilz published chats on Wednesday that suggest that the occupation of the head of the Vienna Public Prosecutor’s Office in 2014 could have been motivated by party politics. At the time, Minister of Justice Wolfgang Brandstetter (ÖVP) did not choose the candidate ranked first by the personnel commission because – according to the portal with reference to the chats – his party did not like it.

According to “ZackZack”, Marek expected in return to be rewarded with the management of the general procuratorate two years later – and because she did not get a chance there, she is said to have written angrily to the then Minister of Justice Wolfgang Brandstetter (ÖVP): ” Thank you for the embarrassing performance in Perskomm. THANK YOU for keeping our conversations and for allowing me to help you out of a hopeless situation. SPRICH (Maria-Luisa) Nittel and Vrabl had to be prevented.”

The publication of the news by “ZackZack” is controversial. Longtime Interior Ministry chief of cabinet Michael Kloibmüller, from whose cell phone they came, said the data was stolen. Brandstetter denied the allegations. (apa)
