Justice orders preventive detention of drug traffickers released after paying bail in Ovalle

The Court of Appeals of La Serena accepted the appeal filed by the Public Prosecutor’s Office and issued an order to innovate for to order the preventive detention of the 23 members of the drug trafficking gang who were released after paying bail in Ovalle.

In light of this, the appellate court instructed the Ovalle Guarantee Court to issue the arrest warrants for the accused as perpetrators of the crimes of illicit association for drug trafficking, illicit drug trafficking and money laundering, after being caught with 1,600 kilos of marijuana.

In a unanimous decision, the First Chamber of the court issued an order not to innovate while the appeal filed by the prosecuting entity is pending resolution.

“The requested no-innovation order is granted, insofar as it provides that the defendants in this case cannot be released while the processing of this appeal is pending, and that the respective arrest warrant must be issued if their release has been decreed, so that they may enter into compliance with the precautionary measure of preventive detention, and the court must issue the corresponding orders and letters in order to comply with this resolution. Let the above be communicated by the most expeditious means,” stated the Court of Appeals.

At the formalization hearing held on Thursday, August 29, the Ovalle Guarantee Court ordered the preventive detention of the 23 defendants due to risk of flight, so set bail at $2 million each, which was paid by those involved.
